Welcome to FinKitty
These Terms of Service ("Terms") govern your use of FinKitty's financial management services and software ("Service") operated by FinKitty Ltd ("we", "our", or "us").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
1. Account Terms
Account Creation
- • You must be at least 18 years old to use FinKitty
- • You must provide accurate and complete information when creating your account
- • You are responsible for maintaining the security of your account and password
- • You must immediately notify us of any unauthorized use of your account
- • One person or legal entity may only maintain one free account
Account Responsibility
You are responsible for all content posted and activity that occurs under your account. This includes all transactions, data, and communications made through your account.
💡 What this means: Keep your account secure and don't share your login details. You're responsible for everything that happens with your account.
2. Service Description
What We Provide
FinKitty provides financial management software that helps small businesses:
- • Track cash flow across multiple bank accounts
- • Categorize transactions automatically
- • Forecast future cash positions using AI
- • Plan financial scenarios and set goals
- • Generate financial reports and insights
Service Availability
We aim to provide 99.9% uptime but cannot guarantee uninterrupted service. We may need to take the service offline for maintenance, updates, or emergency repairs.
💡 What this means: We work hard to keep FinKitty running smoothly, but sometimes we need to do maintenance. We'll let you know in advance when possible.
3. Payment Terms
Subscription Plans
- • Free plans are available with limited features
- • Paid plans are billed monthly or annually in advance
- • All fees are non-refundable except as required by law
- • We may change our prices with 30 days' notice
- • Downgrades take effect at the next billing cycle
Billing
We use Stripe to process payments securely. We don't store your credit card information on our servers. If payment fails, we'll attempt to collect payment again and may suspend your account if payment cannot be collected.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until your subscription expires.
💡 What this means: You can cancel anytime, but we don't provide refunds for unused time. Your subscription stays active until it expires.
4. Data and Privacy
Your Data
You retain all rights to your financial data. We only use your data to provide the FinKitty service and as described in our Privacy Policy. We will never sell your data to third parties.
Data Security
We implement industry-standard security measures to protect your data, including encryption, secure data centers, and regular security audits. However, no method of transmission over the internet is 100% secure.
Data Retention
If you cancel your account, we will retain your data for 30 days to allow for reactivation. After 30 days, all your data will be permanently deleted unless we are required to retain it by law.
💡 What this means: Your data belongs to you. We protect it well and will delete it when you ask us to (with a 30-day grace period for account recovery).
5. Open Banking and Bank Connections
Bank Account Access
We use Open Banking APIs to connect to your bank accounts with read-only access. We cannot move money, make payments, or modify your accounts. You can revoke this access at any time through your bank's online platform or by contacting us.
Third-Party Services
We use GoCardless to facilitate Open Banking connections. Their terms of service and privacy policy also apply to the bank connection service. We are not responsible for any issues with third-party banking services.
Data Accuracy
While we strive for accuracy, financial data may occasionally be delayed or incorrect due to bank API issues. Always verify important information with your bank directly.
💡 What this means: We can only see your bank data, never move your money. Sometimes data might be delayed - always double-check important info with your bank.
6. Acceptable Use
Prohibited Uses
You may not use FinKitty:
- • For any unlawful purpose or to solicit others to perform unlawful acts
- • To violate any international, federal, provincial, or state regulations or laws
- • To transmit or send junk mail, spam, or chain letters
- • To attempt to gain unauthorized access to other users' accounts
- • To interfere with or disrupt the service or servers
- • To use the service to compete with us or build a competing product
Content Standards
Any content you submit must be appropriate and lawful. We reserve the right to remove any content that violates these terms or is otherwise objectionable.
💡 What this means: Use FinKitty for legitimate business purposes only. Don't try to hack us, spam people, or do anything illegal.
7. Limitations of Liability
Service "As Is"
FinKitty is provided "as is" without any warranties. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements.
Limitation of Damages
Our liability to you is limited to the amount you paid us in the 12 months before the incident. We are not liable for any indirect, incidental, or consequential damages.
Financial Decisions
FinKitty provides information and tools to help with financial planning, but we do not provide financial advice. You are responsible for your own financial decisions and should consult with qualified professionals when needed.
💡 What this means: We provide tools and information, but you make your own financial decisions. If something goes wrong, we're only responsible up to what you paid us.
8. Termination
Termination by You
You may terminate your account at any time by canceling your subscription and deleting your account through the settings page or by contacting us.
Termination by Us
We may terminate or suspend your account immediately if you violate these terms, fail to pay fees, or for any reason with 30 days' notice.
Effect of Termination
Upon termination, your right to use FinKitty will cease immediately. You will have 30 days to export your data before it is permanently deleted.
💡 What this means: Either of us can end this agreement. If we do, you get 30 days to download your data before we delete it.
9. Changes to Terms
We may update these Terms from time to time. When we do, we will:
- • Post the new terms on this page
- • Update the "Last Updated" date at the top
- • Notify you via email if the changes are significant
- • Give you 30 days' notice for material changes
Your continued use of FinKitty after any changes indicates your acceptance of the new terms.
💡 What this means: If we change these terms, we'll let you know. By continuing to use FinKitty, you agree to the new terms.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
If any part of these Terms is found to be unenforceable, the remaining parts will remain in full effect.
💡 What this means: UK law applies to these terms. If we have a legal dispute, it will be resolved in UK courts.
